Texas Drifter Minority Lynch Mob Justice
Marshall’s Law Dateline – Appears that yet unknown “why” shooting of young Black man in Florida has again emphasized how President Obama, by not condemning minority lynch mob justice advocated by Black leaders like Al Sharpton, Jesse Jackson, and New Black Panthers; means President Obama supports minority lynch mob justice.
A good starting point for this writing exercise is to remind reader that responsibility always comes with increased responsibilities. Citizens who enter law enforcement, private security, or join neighborhood watch groups are always held to “higher standards”.
Private security and neighborhood watch groups are guided by following principles:
1. Assigned and confined;
2. Best to watch and wait until “backup” being law enforcement arrives;
3. First responsibility is to de-escalate not escalate on scene events.
Translation, private security and neighborhood watch groups’ primary responsibility is to provide surveillance, document accurate on scene intelligence for the “cavalry” when it arrives. This objective does not include unnecessary interventions that result in “shooting up the neighborhood.”
Old adage: best small weapon’s self defense instructor can teach a monkey how to pull a trigger; but cannot teach world’s smartest person when to pull a trigger.
Another adage should be that constitutional due processes are slow and methodical; unlike lynch mob justice which can spontaneously result from media half truth headlines and spread faster than prairie fires.
Another old adage suggest that sometimes justice is like sausage which many would not consumes after seeing how it is made. Reader should never forget that there are two types of constitutional justice in America, criminal and civil. So patience becomes even more trying for victims and special interest haters having too wait completion of two due process systems.
Texas Drifter understands small amount about principles of private security as I am licensed to teach private sector class entitled “Spy As A Verb: Art and Ethics of Surveillance” Following outline is part of that class which tries to teach responsibility always comes with increased responsibilities.
Recreation Ranch Security Guidelines:
1) Prevention through high profile status.
2) Tactics: observe (surveillance) and report (use incident reports and other necessary written, visual, audio equipment).
3) Reduce criminal and civil liability exposure with the following:
- No asking for ID (unless company policy).
- No pretending to be law enforcement.
- No physical detaining (avoids false imprisonment charges).
- No interfering in child custody disputes.
- No arresting (avoids potential kidnapping or false arrest charges due to lack of attention to four arrest criteria and other constitutional requirements).
- No search of person or their private property unless ordered by supervisor (avoids assault and civil rights complaints).
- No abusive language (avoids terrorist threats complaints).
- No interrogations (avoids false terrorist threats complaints).
- No fighting (avoids assault complaints).
- No pursuit chasing on premises (avoids unnecessary potential civil liability injury suits).
- No leaving premises (“assigned and confined rule”).
- No cuffing (avoids improper equipment use civil suits).
- No touching or disturbing evidence (unless necessary to preserve).
- More “no’s” added to list as needed.
4) Have attorney review third party contract relationship between security personnel and customers.
5) Do not violate laws.
6) Report all law breakers to client.
7) Understand client’s policies for customer “careless” and non-sporting behavior (like hunting, guns, and alcohol are never good combination).
8) Do not see or hear what not your business.
9) Necessary force used only for self defense (avoid escalating situations which require using force).
10) Let professional law enforcement do their jobs, and assume liability for their jurisdiction and conduct.
Observations: Good resources for addition information are other ranch scouts and security-law newsletters. Also, applying Texas State Board of Investigators and Security Agencies standards’ based on public sector law enforcement to private ranch security can get ranch scouts, their ranch manager, and ranch owners sued.
Never forget, ranch scouts are employed to protect ranch owners’ property which in today’s litigious society means keeping them from becoming victims of law suit lottery. Potential law suit predators can include: family members, socialite visitors, employees, hunter or photographer customers, illegal immigrants “passing through”, greenist environmental terrorists getting hurt or having rights violated while engaging in acts of terrorism against property owner. Reader should never forget truth like justice is more complicated than initial on scene impressions and ratings’ driven headlines by many vanity and greed driven news reporters. Second part of reader’s assignment: could there be any similarities between two following observations:
1. Origin of lynch mob justice by some Black leaders like Al Sharpton, Jesse Jackson, New Black Panthers, and President Obama suggest that most racism in America is more minorities against whites than whites against minorities?
2. Guns can sometimes make smart people stupid and stupid people brave; and most dangerous of all animals are stupid brave people with guns.
