Lost Innocence: Justice For Some
One prerequisite of social stability which is important for conservatives is equal application of the law or due process.
Let us say for purposes of this writing exercise that an individual interferes with a law enforcement officer’s arrest of a suspected criminal and that the suspect escapes because of the interference and murders, rapes, robs, or kills another citizen in a DUI incident.
Would not justice be required for the person that interfered with the arrest and allowed the bad guy to escape and commit more crimes? Could that accountability be exercised in both criminal and civil liability?
Would the following be a comparable situation: beneficiaries of collateral profits from drug smuggling, human smuggling, kidnapping, and money laundering are also guilty for their actions which interfere with federal governments’ construction of a border fence?
Do not such lost innocence profits include?
1. cheap labor;
2. money laundering from cheap labor on U.S. side of border;
3. expansion of career opportunities for bureaucrats benefiting from services to illegal immigrants (primarily education and social services);
4. retail sales and collateral profits from drug trafficking and smuggling illegal immigrants on U.S. side of border;
5. retail sales on U.S. side of border from drug trafficking and smuggling illegal immigrants from Mexican side of border into U.S.;
6. advertising profits for U.S. print and electronic news media from U.S. retailers making collateral profits from cross border related crimes;
7. money donations to U.S. politicians from cross border collateral profits to insure existing corrupt environment continues to exist?
America’s proposed security fence would curb drug trafficking and smuggling illegal immigrants as well as other crimes like kidnappings along America’s southern border with Mexico.
This reduction of crimes would also reduce collateral profits to those listed above; which results in organized efforts by so called community leaders opposing construction of a fence which would also reduce possibility of terrorist threats and epidemics like tuberculosis brought into America by illegal immigrants.
Even if America had never been attacked by terrorists or never heard the word terrorism, America would need a border fence to protect Americans from health problems brought across the border by illegal immigrants coming from countries with different health standards than those tolerated by America’s health departments.
On the bright side, there is a formula used by at least one government agency to identify geographical regions with higher than acceptable collateral profit crime driven economies. The formula is based on bank deposits, sales taxes, federal income taxes and other appropriate factors.
Liabilities of those interfering with government efforts to reduce trafficking, smuggling, and other cross border crimes by interfering with construction of border fence or other activities should include minimum standards like:
1. criminal liability;
2. civil liability by civil damages for damaged private citizens; and
3. stopping federal funds to offend in agency, school, or political entity.
If equal application of the law or due process is going to become a politically correct process for greedy, prejudice, ignorant citizens, or liberals or populist politicians who get to choose which laws they are accountable too, why should not the same process apply to conservatives?
That was a question for realists, now a question for idealists directed to Homeland Security, If you are not going to enforce laws against individuals or special interest groups interfering with construction of a border fence for collateral profits from criminal activities; would you support changing the phrase “and justice for all” to and justice for some?
